Plain English: These are the rules for browsing this website. Our apps and any paid services each have their own separate terms. Texas law applies.

1. Scope — website only

Plain English: These terms cover the website. Apps and purchases are governed by their own documents.

These Terms of Use apply to the noodlewatt.com website and its pages. Use of any NoodleWatt application is governed by that application’s own terms of service. Each NoodleWatt application, and any paid service offered through this website, is governed by its own separate terms presented at the point of use. If these Terms of Use conflict with an app’s terms or a purchase agreement as to that app or purchase, the more specific document controls.

2. Intellectual property

Plain English: The site’s content and brands are ours. You can view the site; you can’t copy it wholesale.

The website and its content, including text, graphics, design, and the NoodleWatt name and brand, and NoodleWatt’s product and app brands, are owned by NoodleWatt or its licensors and protected by intellectual-property laws. We grant you a limited, revocable license to access and view the website for your personal or internal business use. No other rights are granted.

3. Acceptable use

Plain English: Use the site lawfully. Don’t scrape it, attack it, or pretend to be us.

You agree not to: (a) use the website for any unlawful purpose; (b) scrape, harvest, or bulk-extract content from the website; (c) interfere with or disrupt the website, its servers, or its security features; (d) probe or test vulnerabilities without authorization; or (e) misrepresent your affiliation with NoodleWatt.

4. Third-party links

Plain English: Links to other sites are governed by those sites’ own terms.

The website may link to third-party websites and services, which are governed by their own terms and privacy policies. We are not responsible for their content or practices.

5. Disclaimers

Plain English: The website is provided “as is.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

6. Limitation of liability

Plain English: Our liability for website issues is capped at $50, and indirect damages are excluded. Some states limit these caps.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOODLEWATT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE WEBSITE, AND NOODLEWATT’S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE WEBSITE WILL NOT EXCEED FIFTY U.S. DOLLARS (US $50). Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

7. Governing law and venue

Plain English: Texas law; Smith County courts.

These Terms of Use are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute arising out of or relating to the website or these Terms of Use will be brought exclusively in the state or federal courts located in Smith County, Texas, and you consent to personal jurisdiction and venue there.

8. Changes

Plain English: Updates get posted here with a new date; continued use means acceptance.

We may update these Terms of Use from time to time by posting the updated version at this page with a new effective date. Your continued use of the website after changes take effect constitutes acceptance.

9. General

Plain English: Housekeeping.

If any provision of these Terms of Use is unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms of Use; we may assign them in connection with a merger, acquisition, or sale of assets.
